AGREEMENT TO OFFICIAL RULES: The Trombone Shorty Tickets Drawing (the “Drawing”) is available only to legal residents of the state of Colorado, ages 18 and older, and shall be governed by Colorado law. By participating in the Drawing, you agree to abide by and be bound by these Official Rules and the decisions of Climb Credit Union, which shall be final and binding in all matters related to the Drawing.
ELIGIBILITY: The Drawing is open only to individuals who are legal residents of the state of Colorado and are 18 years of age or older at the time of entry. Employees of Climb Credit Union, their immediate families (parent, child, sibling, or spouse) and/or persons living in their household, and any other persons associated with this Drawing (“Official Family”) are ineligible to enter the Drawing or win the prize. The Drawing is void outside of the state of Colorado and where otherwise prohibited by law.
SPONSOR/ADMINISTRATOR: The Drawing is sponsored and administered by Climb Credit Union, 5005 W 60th Ave, Arvada, CO 80003 (“Sponsor”).
HOW TO ENTER: The entry period for the Drawing will begin April 1st, 2025, starting at 8:00 a.m. MST and conclude on April 25th at 7:30 p.m. MST (the “Drawing Period”). Eligible persons can enter the Drawing by purchasing tickets to the April 25th performance of A Gentleman's Guide to Love and Murder at the Arvada Center and using promo code CLIMB, or by mailing a letter containing their name, phone number, address, email address, and whether they are a Climb Credit Union member to Climb Marketing, 5005 W 60th Ave, Arvada, CO 80003. All entries must be received by 7:30 p.m. MST on April 25, 2025.
Each completed Drawing entry timely received by the Sponsor will generate one (1) Drawing entry. Entry is limited to only one (1) entry per person, and only one entry will be permitted using any specific phone number. Any attempt to obtain more than one entry by using multiple/different phone numbers, names, identities, or any other methods will void that person’s entry(s) and result in their disqualification from winning the prize.
CONDITIONS OF PARTICIPATION: If for any reason the operation or administration of this Drawing is impaired or incapable of running as planned due to (a) infection by computer virus, bugs, (b) tampering or unauthorized intervention, (c) fraud, (d) technical failures, or (e) any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Drawing, the Sponsor reserves the right, in its sole and absolute discretion, to disqualify any person who tampers with the entry process, and/or to cancel, terminate, modify, or suspend the Drawing in whole or in part, at any time, without notice. The Sponsor may award the applicable prize using all non-suspect eligible entries received as of or after such cancellation, termination, modification, or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules as determined by the Sponsor in its sole discretion. The Sponsor reserves the right to disqualify any person deemed to be tampering with the entry process and/or acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. DRAWING AND NOTIFICATION: One (1) prize will be awarded to one (1) winner. The winner will be selected by random drawing conducted by the Sponsor from all eligible entries received by the Sponsor, whose decisions are final and binding. The prize drawing will be conducted on or about April 28, 2025. The winner will be contacted by the Sponsor at the telephone number and/or email address provided with the entry. If a potential winner cannot be contacted at the phone number and/or email address provided within three (3) business days after the first attempt to contact him/her, the Sponsor may select an alternate potential winner in his/her place at random from the remaining entries.
ODDS OF WINNING: Odds of winning will depend on the total number of eligible entries received throughout the Drawing Period. All eligible Drawing entries will have an equal chance to win the prize.
PRIZE: There is one (1) prize that will be given to one (1) winner. The prize includes: two (2) tickets to the Trombone Shorty performance at the Arvada Center on June 18, 2025.
PRIZE CONDITIONS: The potential prize winner is required to sign a Media/Publicity Release and return it to the Sponsor within seven (7) business days of notification, or the prize may be forfeited and an alternate potential winner selected. If a potential prize winner cannot be notified, fails to return the required document within the specified time period, or is not in compliance with these Official Rules, that person shall be disqualified, and an alternate winner will be selected. The Sponsor reserves the right to substitute the prize with another prize of equal or greater value if the prize (or any component thereof) is not available as determined by the Sponsor.
TAXES AND TAX REPORTING: Prize winners are solely responsible for all federal, state, and local taxes, and any expenses associated with the prize. Prize winners must provide all necessary information for the Sponsor to make required tax reports. Failure to provide such information shall result in the prize being forfeited.
RELEASE AND HOLD HARMLESS: By entering the Drawing and/or accepting a prize, each participant in the Drawing agrees to hold the Sponsor and its officers, directors, employees, representatives, and agents harmless from any and all liability in connection with the Drawing, including, without limitation, legal claims, costs, injuries, losses, or damages. This includes claims related to (a) any errors that may prevent a person from submitting an entry; (b) unauthorized human intervention; (c) printing errors; (d) errors in the administration of the Drawing or the processing of entries; (e) injury, death, or damage to persons or property; (f) claims based on publicity rights, defamation, use of image or likeness, and/or breach of any right of privacy; or (g) any other claims or actions of any kind. Except where prohibited by law, acceptance of a prize constitutes a release of any and all claims in connection with the administration of the Drawing and the use, misuse, or possession of any prize. The Sponsor is not responsible for any printing, typographical, mechanical, or other errors in the administration of the Drawing or the announcement of the prize.
LIMITATION OF LIABILITY: IN NO EVENT WILL SPONSOR, ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND/OR AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS DRAWING OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE.
PUBLICITY AUTHORIZATION: The Sponsor may use any prize winner’s name, photo, voice, likeness, and/or city of residence for promotional purposes via any and all forms of media, in perpetuity, without further notice, attribution, permission, or compensation, except where prohibited by law. Prize winners agree that their name and prize may be revealed to other Drawing participants upon request.
COMPLIANCE WITH LAW: All issues and questions concerning the Drawing, these Official Rules, the rights of the participants in connection with the Drawing, any dispute arising between Sponsor and any Drawing participant, and/or any dispute concerning the administration of the Drawing shall be governed by and construed in accordance with the laws of the State of Colorado and applicable federal law.
